摘要：中華人民共和國海事局（原中華人民共和國海上安全監(jiān)督局）是我國海上交通安全監(jiān)督和海洋環(huán)境保護行政主管機關，他的這一職能是法律所賦予的?！吨腥A人民共和國海上交通安全法》賦予海事主管機關對交通事故的調(diào)查處理權力。1984年11月以后，最高人民法院相繼在廣州、上海等地設立了海事法院，海事法院專門受理海商案件，對海事法院判決和裁定不服的上訴案件，由海事法院所在地高級人民法院管轄。由此產(chǎn)生了對海事行政主管機關調(diào)查處理海事權能的爭議，2000年7月1日后《中華人民共和國海事訴訟特別程序法》的生效，更使這種爭議不斷升級。經(jīng)?？吹揭恍┍M陳海事主管機關解決因海事而引起的民事糾紛案件的弊端的文章，提出海事主管機關調(diào)查、調(diào)解、處理海事的權能應完全由海事法院的司法程序予以替代，本人并不贊成這一觀點，但對海事調(diào)查、調(diào)解、處理現(xiàn)狀作客觀的總結，進一步作一些探討，從而推進我們的工作，應該是明智之舉，更是“執(zhí)政為民”的具體體現(xiàn)。

本文先對海事行政主管機關的行政職權、工作性質(zhì)作了粗淺的介紹，以使從未接觸過這一專業(yè)性較強的工作的同志對這一工作有所了解。通過圍繞海事行政主管機關調(diào)查處理海事的合法性、有效性、便捷性，分析海事行政主管機關和海事法院解決海事所引起的民事糾紛案件的利弊，闡述了這一行政職能存在的必要性。同時還指出了海事行政主管機關目前開展這項工作存在的不足，指出其自我完善的緊迫性，并就改進和完善海事行政主管機關海事調(diào)查處理現(xiàn)狀，提出一些不成熟之個人愚見。
